Biography
Bernice K.
Leber's practice focuses on commercial litigation, covering a
wide variety of subject matter including real estate,
construction, financial, securities, intellectual property,
and international transaction litigation.
Over the course of her career Ms. Leber has handled cases
involving contract, partnership, lenders, RICO and securities
fraud (in the areas of oil and gas, mining, wind energy, coal,
livestock and photonegative limited partnerships). She was
lead defense counsel for 11 defense groups in In Re Amarex
Securities Litigation, one of the largest multidistrict cases
filed in the Southern District of New York, where she
represented two outside directors and the largest corporate
shareholder of the general partner of the oil and gas drilling
exploration program. Those cases later involved the Penn
Square Bankruptcy Litigation. She has also argued the leading
case in the Second Circuit on investment advisor liability
under the ERISA laws in an action involving the maritime union
pension funds. She has been involved in construction
litigation for developers, owners and tenants as well as
lender liability cases arising there from. She has both
defended and prosecuted cases involving broker dealers before
the district courts, NYSE, ASE and AAA and commodities
contracts before the Coffee, Sugar & Cocoa Exchange.
In October 2000, Ms. Leber lectured to Supreme Court Justices,
and in July 1997, Ms. Leber lectured to 300 New York State
Court Judges at their annual statewide conference on a federal
and state law decision affecting the courts. Ms. Leber is a
member of the Executive Committee of the New York State Bar
Association, former Chair of the New York State Bar
Association's Commercial and Federal Litigation Section
(1997-1998), past Chair-Elect of the Section, past Chair of
Subcommittees on Discovery, Appellate Practice, Federal
Judiciary, and a member of the Courts of Superior Jurisdiction
(1995-1998), Committee on Judicial Administration and the
Civil Courts Committee for the Association of the Bar of the
City of New York. Ms. Leber has lectured on a variety of
subjects to bar groups including: Federal Civil Practice,
Arbitration, Loan Workout Litigation, the Commercial Courts of
the Supreme Court and Case Management Techniques.
Ms. Leber was Legislative Assistant to New York State Senator
Mary Anne Krupsak (1973 1974), Parliamentarian to the New York
State Senate (1975 Session), and a Member of the New York
State Temporary State Commission on Management and
Productivity (1976).
